Clarification on
Medicare for Patients and Providers Act of 2008 (MIPPA)

MIPPA section 154(b) added a new subparagraph (F) to section 1834(a)(20) of the Social Security Act. This subparagraph states that eligible professionals and other persons are exempt from meeting the September 30, 2009, accreditation deadline that generally applies to other DMEPOS(Durable Medical Equipment, Prosthetics, Orthotics, and Supplies) suppliers unless the Centers for Medicare & Medicaid Services (CMS) determines that the quality standards are specifically designed to apply to such professionals and persons.

The eligible professionals to whom this exemption applies are set out at sections 1848(k)(3)(B) and 1861(r) of the Act, and include: Physicians, Physical Therapists, Occupational Therapists, Qualified Speech-Language Pathologists, Physician Assistants, and Nurse Practitioners.
Additionally, section 154(b) of MIPPA allows the Secretary to specify “other persons” that, like the eligible professionals described above, are exempt from meeting the DMEPOS accreditation requirements unless CMS determines that the quality standards are specifically designed to apply to such other persons. At this time, CMS is defining “such other persons” as: Orthotists, Prosthetists, Opticians, and Audiologists.

CMS will define how the quality standards apply to these eligible professionals and other persons by rulemaking in 2009.

Individuals not included in this exemption list--such as pedorthotists, mastectomy fitters, orthopaedic fitters/ technicians, or athletic trainers applying for Medicare enrollment in order to bill for Medicare part B services--are not exempt from meeting the September 30, 2009, deadline for DMEPOS accreditation.

Not in a Bargaining Unit? Pay Less Dues!

At the April 2006 ONA House of Delegates there was majority support for the dues differential becoming a permanent part of the ONA bylaws. This means that if you are not part of a collective bargaining unit that you can elect to pay 50% of the total sum of the ONA dues each year.

You will continue to pay ON-PAC dues and NU-PAC dues along with your ANA dues. You need to notify the ONA office at the time of membership renewal if you desire to make this change in paying your dues. Spread the word! Tell colleages!

Pain Management CE

The OSBN website now has general information on this requirement, which will be in effect from 2004-2009. This is a one-time requirement, and is mandated by the state for all MDs, RNs, PAs, Chiropractors, Naturopaths, Psychologists and Clinical SocialWorkers. There have been links provided to several online options which arefree or low cost. Please note that these are only a few of the many availableoptions, and that coursework taken by NPs at the advanced level which offers CME, or CNE and concerns pain management, end of life or palliative care maybe used towards this requirement upon renewal of your license. The Board is anticipating that the Pain Commission will notify us of their one credit course which is part of the requirement, by December 2004. Links and information can be found at:
