Proposed Portable X-ray Rule Change

Current CMS (Center for Medicare/Medicaid Services) rules for reimbursement do not allow NPs, PAs or other non-physician practitioners to order portable x-rays in nursing homes or patient’s residence.  In the Medicare Conditions for Coverage regulations established in 1969, the rule requires that "portable x-ray examinations are performed only on the order of a doctor of medicine (MD) or doctor of osteopathy (DO).  These regulations predate the existence of most NP legislation in states across the country thus represent out dated policy. 

NPs play a critical role in the care of residents in nursing homes and other non-hospital settings.  On July 30, CMS proposed new rules in the "Revisions to Payment Policies Under the Physician Fee Schedule” (see link below). This new proposed rule is critical to allow NPs and PAs to order portable x-rays. We believe there was no intent to exclude the NPs, PAs and other non-physician practitioners from legal authority to order portable X-ray. 

To make this new rule permanent in the Federal Registry, it must be voted on by Congress.  The public comment period on this rule is open right now until September 4th.  We are asking for your help in joining us to advocate for this rule change to be implemented retroactively as well as for the future, in the interest of patient care in nursing homes.
