Workers’ Compensation Rule Change Affects Nurse Practitioners

Revised OAR 436-010, "Medical Services”

  • Authorized nurse practitioners are now allowed to treat injured workers and authorize time loss for 180 days. (Previously, authorized nurse practitioners were allowed to treat injured workers for 90 days and authorize time loss for 60 days.)

Revised OAR 436-015, "Managed Care Organization (MCO) Rules”

  • MCOs must now annually report denials and terminations of the authorization of primary care physicians, chiropractic physicians, and nurse practitioners who are not members of the MCO.
  • MCOs may now deny authorization based upon past practices to nonpanel primary care physicians, chiropractic physicians, and authorized nurse practitioners, who might otherwise qualify to continue treatment of workers after enrollment in the MCO.

These changes are a result of the work that ONA and NPO has done to remove this barrier to NP practice. Thank you to all of the NPs who have worked so hard to make these changes a reality.
